Civil Money Penalty Funds
When a nursing home does not comply with one or more Medicare and Medicaid requirements, the Centers for Medicare and Medicaid Services (CMS), which is a federal agency, may impose a Civil Money Penalty. The nursing home must pay a fine based either on the number of days or for each instance they are not in compliance. CMS returns a portion of the money collected from fines to the state where the nursing home is located. State CMP funds are reinvested to support activities that benefit nursing home residents and that protect or improve their quality of care or quality of life.
In Delaware, Civil Money Penalty funds are held in the Long Term Care Residents’ Trust Fund, where they are managed by the Department of Health and Social Services and its Division of Health Care Quality for the benefit and protection of residents of long-term care facilities. Expenditures are available for public review.
Civil Money Penalty Reinvestment Program (CMPRP)
State CMP Project Application Form to request the approval of state-funded Civil Money Penalty Reinvestment Projects. State CMP Projects are approved and monitored by DHCQ and are separate from federal CMP applications.

Federal CMP Reinvestment Projects are approved and monitored by both DHCQ and The Centers for Medicare and Medicaid Services.

Project Title: It’s Music & Memory

| Project Summary | The project will utilize a project coordinator to train care professionals in the final nine federally Certified Nursing Home Facilities on implementing the Music & Memory approach to dementia care to 10 selected residents at each facility. Professionals will be trained to set up personalized music playlists, delivered on MP3 players and other digital devices, for those in their care. These musical favorites tap deep memories not lost to dementia and can bring participants back to life, enabling them to feel like “themselves again” to converse, socialize and stay present. |

| Results of Completed Projects | Brenda Zullo from Atlantic Shores Rehabilitation Center has mentioned that her residents enjoy this program. She mentioned a story about one of her residents, who recently passed, who requested to listen to his music during his last moments. Project Title: Dementia and Psychotropic Medications Workshop

While tracking the general mood of the resident, ECC reported the following, “Excited! This resident is verbal, mobile and developmentally on target so he understood that this device was a new, exiting ‘toy’ in our facility. He had a great time helping us get to know the system in terms of navigation and he enjoyed the freedom of being able to select games that he thought seemed ‘cool’. This particular resident does occasionally need to be in his chair due to respiratory issues so it will be good to see how he uses the device in the future while seated.” |
