Billboard Advertising Clean Indoor Air Act

On November 27, 2002, the Delaware Clean Indoor Air Act took effect. Smoking is not permitted in workplaces and most indoor public places, including but not limited to:

• Indoor workplaces
• Restaurants, bars, taverns and taprooms
• Grocery stores
• Public meeting areas and courtrooms
• Day care facilities, and private home areas used for day care
• Hospitals, clinics and other health care facilities
• Restrooms, lobbies, hallways, elevators and other common areas in motels, hotels and apartment buildings
• At least 75% of the guest rooms in any hotel or motel
• Gaming facilities (casinos) open to the public
• Bowling alleys, billiard halls and pool halls
• Theaters, auditoriums and museums
• Libraries
• All schools
• Indoor sports arenas

The purpose of the Clean Indoor Air Act is to protect the health and environment of the people of Delaware. Because three out of four people in Delaware don’t smoke, we’re asking smokers to protect the health of others by smoking outside or in areas where smoking is permitted. There are some exemptions from the law, listed below. For more detailed information, please read the Clean Indoor Air Act Regulations .

• Private homes, residences and vehicles, except when they are used for day care
• Indoor areas where private social functions are held
• Limousines under private hire
• Hotel or motel rooms rented to one or more guests where the total percentage of smoking rooms does not exceed 25 percent
• Fundraising activities and functions sponsored by volunteer fire, rescue or ambulance companies or their auxiliaries on their property
• Any fundraising activity sponsored by a fraternal society on their property
