DUI Rehabilitation Programs


The Division of Substance Abuse and Mental Health (DSAMH) is charged with administering and overseeing DUI Education and Treatment Programming for individuals who are required to complete such a program as a result of a violation of Delaware’s Driving While Intoxicated law.

DSAMH promulgated regulations for the administration of such programs and issued Standard Operating Procedures for participants as well as providers contracted to facilitate these programs.

The first step in fulfilling the requirements of Delaware’s DUI Education and Treatment Programs is to complete a DUI screening and referral, which is operated by DSAMH’s Treatment Access Center (TASC) under its DUI Referral Services (DRS) program.


DUI Referral Services (DRS)

How to contact:

Individuals requiring DUI Referral Services may contact DRS by phone, email, or by reporting in person to one of three locations in Delaware.

When contacting DRS by phone, mention you are calling regarding DUI Referral Services.

Materials to have ready when contacting DRS:

  • Date of DUI arrest
  • Blood Alcohol Content (BAC) reading
  • DUI ticket number or court order

General Information:

DRS screenings are completed via telehealth or in-person if requested.

To participate via telehealth, individuals will need:

  • An active internet connection
  • A working camera and microphone (e.g., smartphone, tablet, computer with webcam)
  • To remain on camera throughout the screening

In-person screenings are available in each county.

DUI screenings are provided free of charge.

Each new DUI, Probable Cause, or Reckless Driving Alcohol related charge after an initial screening date requires a new DUI screening.

DRS screening appointments last approximately 60 minutes.

The purpose of the screening is to gather information regarding the DUI incident and the individual’s substance use history.

Following the screening, each participant will be assigned to an available DUI Program agency in Delaware (listed below):


Out-of-state Violations

Residents with a Delaware Driver’s License charged with a DUI in a state other than Delaware must complete a DRS screening in Delaware.

Participants are responsible for and must present the following information and documents:

  • Date of DUI arrest
  • Blood Alcohol Content (BAC) reading
  • Out-of-state DUI ticket number or court order

This documentation is required before or on the date of the screening.


Out-of-state Participants

Participants who are ticketed in Delaware but live in another state must meet the Delaware requirements for DUI screening and program completion to have their DUI obligations lifted from the national DMV registry.

Participants must complete a DRS screening and select a Delaware DUI program provider to manage their case in Delaware.

Participants are responsible for and must present the following information and documents:

  • Date of DUI arrest
  • Blood Alcohol Content (BAC) reading
  • Out-of-state DUI ticket number or court order

This documentation is required before or on the date of the screening.

The participant will be able to complete education or treatment in their state of residence.

Repeat DUI Offender Program

INFORMATION FOR REPEAT DUI OFFENDERS

Some individuals who have been convicted of a third DUI are required to participate in a three-month-long intensive outpatient program at the direction of the Department of Correction.
