Please click on the link below to view the documents for more information on the proposed amendment and your opportunity to provide input into this process.<br>\n\n\n\n<a href=\"homeandc.html\">Home and Community<\/a><\/p>\n\n\n\n\n\n\n\n<h2>\u00a0<\/h2>\n\n\n\n\n\n\n\n<h2><strong>HCBS Public Comments Now Available to View<\/strong><\/h2>\n\n\n\n\n\n\n\n<p>In January 2014, the Centers for Medicare &#038; Medicaid Services (CMS)\u00a0published the home and community-based services (HCBS) final rule, also known as the Community Rule. The Community Rule is intended to support home and community-based (HCB) settings as an alternative to institutional care for participants in Medicaid HCBS programs.<\/p>\n\n\n\n\n\n\n\n<p>CMS required all states to develop a Statewide Transition Plan to outline how they would come into compliance with the Community Rule.\u00a0 On March 17, 2015, after working with stakeholders across Delaware, a Transition Plan was developed and submitted to CMS for approval. The Statewide Transition Plan describes the activities Delaware will undertake to achieve full compliance with all federal requirements by the required date of March 17, 2019.<\/p>\n\n\n\n\n\n\n\n<p>Delaware\u2019s Statewide Transition Plan specifies all the services, delivered in both residential and non-residential settings, which will be reviewed to determine compliance with federal requirements in the Community Rule. Specifically, the Transition Plan outlines the actions that Delaware will take to:<\/p>\n\n\n\n\n\n\n\n<ul>\n\n\n\n <li>Engage stakeholders in all phases of the process;<\/li>\n\n\n\n <li>Assess relevant policies and regulations at all levels, as well as provider settings against the Community Rule;<\/li>\n\n\n\n <li>Develop and implement strategies to remediate non-compliant situations; and<\/li>\n\n\n\n <li>Demonstrate full compliance with the Community Rule by March 17, 2019.\u00a0<\/li>\n\n\n\n<\/ul>\n\n\n\n\n\n\n\n<p>As Transition Plan activities are implemented, we will continue to update this site with additional information and materials.
