To be eligible, the adult Delaware resident must be:<\/p>\r\n<ul>\r\n<li>Determined as terminally ill by an attending and consulting physician or APRN.<\/li> \r\n\t<li>Given a prognosis of six months or less to live.<\/li>\r\n\t<li>Acting voluntarily.<\/li>\r\n\t<li>Determined to have capacity to make healthcare decisions. <\/li>\r\n<\/ul>\r\n<p><a href=\"https:\/\/legis.delaware.gov\/SessionLaws\/Chapter\/GetPdfDocument?fileAttachmentId=649151\">Session Law of the Ron Silverio\/Heather Block End of Life Options Act<\/a><br>\r\n<a href=\"https:\/\/regulations.delaware.gov\/register\/march2026\/final\/29 DE Reg 783 03-01-26\">Final Order for 4603: End of Life Options<\/a><\/p>\r\n\r\n<h2>Department Role<\/h2>\r\n<p>The Department of Health &amp; Social Services, by way of the Division of Public Health\u2019s Bureau of Vital Records and Health Statistics, is charged with creating an annual report and collecting limited information about patients that participate in the Act to ensure provider compliance with the law.
