ACCESS TO PRIVATE RESTROOMS\n\n\n\n\n      <\/h3><br>\n\n\n\n\n      <h4>\n\n\n\n\n        \u00a7 3001H Definitions.\n\n\n\n\n      <\/h4>\n\n\n\n\n      <ul style=\"list-style-type:none\">\n\n\n\n\n        <li>For purposes of this chapter:\n\n\n\n\n        <\/li>\n\n\n\n\n        <li style=\"list-style: none; display: inline\">\n\n\n\n\n          <ul style=\"list-style-type:none\">\n\n\n\n\n            <li>(1)\u2002&#8221;Customer&#8221; means an individual who is lawfully on the premises of a retail establishment.\n\n\n\n\n            <\/li>\n\n\n\n\n            <li>(2)\u2002&#8221;Eligible medical condition&#8221; means Crohn&#8217;s disease or ulcerative colitis, celiac disease, any other inflammatory\n\n\n\n\n            bowel disease, irritable bowel syndrome, or any other medical condition that requires immediate access to a restroom facility.\n\n\n\n\n            <\/li>\n\n\n\n\n            <li>(3)\u2002&#8221;Restroom&#8221; means a room containing a toilet.\n\n\n\n\n            <\/li>\n\n\n\n\n            <li>(4)\u2002&#8221;Retail establishment&#8221; means any business or place where members of the public have access as invitees,\n\n\n\n\n            licensees, or customers.\n\n\n\n\n            <\/li>\n\n\n\n\n          <\/ul>\n\n\n\n\n        <\/li>\n\n\n\n\n      <\/ul>\n\n\n\n\n      <p>\n\n\n\n\n        79 Del. Laws, c. 414, \u00a7 1.;\n\n\n\n\n      <\/p>\n\n\n\n\n      <h4>\n\n\n\n\n        \u00a7 3002H Access to restrooms.\n\n\n\n\n      <\/h4>\n\n\n\n\n      <ul style=\"list-style-type:none\">\n\n\n\n\n        <li>(a)\u2002A retail establishment that has a restroom facility for its employees, not usually accessible to the public, shall\n\n\n\n\n        allow a customer to use that facility during normal business hours if the following conditions are met:\n\n\n\n\n        <\/li>\n\n\n\n\n        <li style=\"list-style: none; display: inline\">\n\n\n\n\n          <ul style=\"list-style-type:none\">\n\n\n\n\n            <li>(1)\u2002The customer requesting the use of the employee restroom facility suffers from an eligible medical condition or\n\n\n\n\n            uses an ostomy device, provided that the existence of the condition or device is documented in writing by a physician or other\n\n\n\n\n            licensed medical professional, or an identification card that is issued by a nationally-recognized health organization or state\n\n\n\n\n            agency and that indicates the customer suffers from an eligible medical condition or uses an ostomy device;\n\n\n\n\n            <\/li>\n\n\n\n\n            <li>(2)\u2002Three or more employees of the retail establishment are working at the time the customer requests the use of the\n\n\n\n\n            employee restroom facility;\n\n\n\n\n            <\/li>\n\n\n\n\n            <li>(3)\u2002The employee restroom facility is not located in an area where providing access would create an obvious health or\n\n\n\n\n            safety risk to the customer or an obvious security risk to the establishment;\n\n\n\n\n            <\/li>\n\n\n\n\n            <li>(4)\u2002Accessing the bathroom would not expose the customer to sensitive company documents, materials, or trade secrets;\n\n\n\n\n            <\/li>\n\n\n\n\n            <li>(5)\u2002Accessing the bathroom would not cause the retail establishment to cease or significantly curtail normal business\n\n\n\n\n            operations; and\n\n\n\n\n            <\/li>\n\n\n\n\n            <li>(6)\u2002A public restroom is not immediately accessible to the customer.\n\n\n\n\n            <\/li>\n\n\n\n\n          <\/ul>\n\n\n\n\n        <\/li>\n\n\n\n\n        <li>(b)\u2002For purposes of this section, an &#8220;obvious health or safety risk&#8221; would include but is not limited to a situation\n\n\n\n\n        where accessing the employee restroom facility requires the customer to traverse an area where manufacturing or heavy equipment is\n\n\n\n\n        in use, items are stored on high shelves, adequate lighting is not present, the floor may be wet or slippery, or hazardous\n\n\n\n\n        materials are used or stored.\n\n\n\n\n        <\/li>\n\n\n\n\n      <\/ul>\n\n\n\n\n      <p>\n\n\n\n\n        79 Del. Laws, c. 414, \u00a7 1.;\n\n\n\n\n      <\/p>\n\n\n\n\n      <h4>\n\n\n\n\n        \u00a7 3003H Physical changes or improvements.\n\n\n\n\n      <\/h4>\n\n\n\n\n      <ul style=\"list-style-type:none\">\n\n\n\n\n        <li>This chapter does not require a retail establishment to make any physical changes or improvements to an employee restroom\n\n\n\n\n        facility located on the premises.\n\n\n\n\n        <\/li>\n\n\n\n\n      <\/ul>\n\n\n\n\n      <p>\n\n\n\n\n        79 Del. Laws, c. 414, \u00a7 1.;\n\n\n\n\n      <\/p>\n\n\n\n\n      <h4>\n\n\n\n\n        \u00a7 3004H Penalty.\n\n\n\n\n      <\/h4>\n\n\n\n\n      <ul style=\"list-style-type:none\">\n\n\n\n\n        <li>A violation of this chapter shall for the first offense receive a warning. Any subsequent offense shall be punished by a civil\n\n\n\n\n        penalty of $100.\n\n\n\n\n        <\/li>\n\n\n\n\n      <\/ul>\n\n\n\n\n      <p>\n\n\n\n\n        79 Del. Laws, c. 414, \u00a7 1.;\n\n\n\n\n      <\/p>\n\n\n\n\n      <h4>\n\n\n\n\n        \u00a7 3005H Enforcement.\n\n\n\n\n      <\/h4>\n\n\n\n\n      <ul style=\"list-style-type:none\">\n\n\n\n\n        <li>The Division of Public Health shall enforce the provisions of this chapter. Any civil penalties collected under this chapter\n\n\n\n\n        shall be directed to the Division of Public Health for enforcement and education related to this chapter.\n\n\n\n\n        <\/li>\n\n\n\n\n      <\/ul>\n\n\n\n\n      <p>\n\n\n\n\n        79 Del. Laws, c. 414, \u00a7 1.;\n\n\n\n\n      <\/p>\n\n\n\n\n      <h4>\n\n\n\n\n        \u00a7 3006H Identification cards.\n\n\n\n\n      <\/h4>\n\n\n\n\n      <ul style=\"list-style-type:none\">\n\n\n\n\n        <li>The Division of Public Health shall develop a standard identification card that may be signed by a licensed physician as\n\n\n\n\n        evidence of the existence of an eligible medical condition as defined in \u00a7 3001H of this title. The Division of Public Health\n\n\n\n\n        may include a disclaimer on the card which would indicate that the Division of Public Health has not verified the authenticity of\n\n\n\n\n        the physician&#8217;s signature.\n\n\n\n\n        <\/li>\n\n\n\n\n      <\/ul>\n\n\n\n\n      <p>\n\n\n\n\n        80 Del.
