These Regulations establish standards for the enforcement of the Clean Indoor Air Act as it\n\n\n  relates to most indoor enclosed areas to which the general public is invited or in which the general public is permitted. Regulations\n\n\n  establishing standards for the enforcement of the Clean Indoor Air Act affecting employers, employees and the workplace are adopted by\n\n\n  the Department of Labor.\n\n\n<\/p>\n\n\n<h4>\n\n\n  99.102 Purpose\n\n\n<\/h4>\n\n\n<p>\n\n\n  These regulations shall be construed and applied to protect the nonsmoker from involuntary exposure to environmental tobacco smoke in\n\n\n  most enclosed indoor areas to which the public is invited or in which the general public is permitted. The purpose of the Clean Indoor\n\n\n  Air Act is to preserve and improve the health, comfort and environment of the people of this State by limiting exposure to tobacco smoke.\n\n\n<\/p>\n\n\n<h4>\n\n\n  99.103 Severability\n\n\n<\/h4>\n\n\n<p>\n\n\n  In the event any particular clause or section of the regulations should be declared invalid or unconstitutional by any court of competent\n\n\n  jurisdiction, the remaining portions shall remain in full force and effect.\n\n\n<\/p>\n\n\n<h4>\n\n\n  99.104 Date of Effect\n\n\n<\/h4>\n\n\n<p>\n\n\n  These regulations shall be effective March 10, 2003.\n\n\n<\/p>\n\n\n<h4>\n\n\n  99.105 Inspections\n\n\n<\/h4>\n\n\n<p>\n\n\n  The Secretary, DHSS, or authorized designee shall have right of entry into any enclosed indoor area subject to 16 Delaware Code Chapter\n\n\n  29.\n\n\n<\/p>\n\n\n<h4>\n\n\n  99.106 Waiver\n\n\n<\/h4>\n\n\n<p>\n\n\n  The Department of Health and Social Services may upon written request waive the provisions of these Regulations if the Department\n\n\n  determines there are compelling reasons to do so, and such waiver will not significantly affect the health and comfort of non-consumers\n\n\n  of tobacco products.\n\n\n<\/p>\n\n\n<h4>\n\n\n  99.107 Definitions\n\n\n<\/h4>\n\n\n<p>\n\n\n  The following words, terms, and phrases when used in these regulations, shall have the meaning ascribed to them in this section, except\n\n\n  where the context clearly indicates a different meaning.\n\n\n<\/p>\n\n\n<p>\n\n\n  For the purposes of these Regulations:\n\n\n<\/p>\n\n\n<ul>\n\n\n  <li>\n\n\n    <strong>99.107.1<\/strong> \u201cDepartment\u201d means the Delaware Health and Social Services (DHSS) as defined in 29 Delaware Code,\n\n\n    Section 7901.\n\n\n  <\/li>\n\n\n  <li>\n\n\n    <strong>99.107.2<\/strong> \u201cEnvironmental tobacco smoke\u201d (ETS), or \u201csecondhand smoke\u201d is the complex mixture\n\n\n    formed from the escaping smoke of a burning tobacco product (termed as sidestream smoke) and smoke exhaled by the smoker. Exposure to\n\n\n    ETS is also frequently referred to as \u201cpassive smoking\u201d or \u201cinvoluntary smoking.\u201d\n\n\n  <\/li>\n\n\n  <li>\n\n\n    <strong>99.107.3<\/strong> \u201cEnclosed Indoor Area\u201d means an indoor area that is neither open nor partially enclosed.\n\n\n  <\/li>\n\n\n  <li>\n\n\n    <strong>99.107.4<\/strong> &#8220;Fraternal Benefit Society\u201d means any incorporated society, order or supreme lodge, without\n\n\n    capital stock, including one exempted under the provisions of 18 Delaware Code 6237(a)(2) of this title, whether incorporated or not,\n\n\n    conducted solely for the benefit of its members and their beneficiaries and not for profit, operated on a lodge system with ritualistic\n\n\n    form of work, having a representative form of government and which provides benefits in accordance with this chapter, is hereby\n\n\n    declared to be a fraternal benefit society.\n\n\n  <\/li>\n\n\n  <li>\n\n\n    <strong>99.107.5<\/strong> \u201cPrivate Club\u201d means any club or organization that does not permit the general public to access\n\n\n    its facilities or activities. Access is denied to anyone who does not agree or adhere to the rules of membership. In order to be\n\n\n    considered a private club or organization for purposes of the Clean Indoor Air Act, the establishment must adhere to all of, but not\n\n\n    limited to, the following criteria.\n\n\n    <ol class=\"lower-alpha\">\n\n\n      <li>Have a permanent mechanism to carefully screen applicants for membership on subjective rather than objective factors;\n\n\n      <\/li>\n\n\n      <li>Limits access and use of facilities, services and activities of the organization to members and guests of the members;\n\n\n      <\/li>\n\n\n      <li>Is controlled by its membership and operates solely for the benefit and pleasure of its members;\n\n\n      <\/li>\n\n\n      <li>Advertises exclusively and only to its members, excluding membership drives.\n\n\n      <\/li>\n\n\n    <\/ol>\n\n\n  <\/li>\n\n\n  <li>\n\n\n    <strong>99.107.6<\/strong> \u201cPrivate social function\u201d means a function to which the public is neither invited nor generally\n\n\n    permitted access and which is held in a separate indoor enclosed indoor area.\n\n\n  <\/li>\n\n\n  <li>\n\n\n    <strong>99.107.7<\/strong> \u201cPublic transportation of children\u201d means transportation which involves the transportation of\n\n\n    children by a vehicle under the control of a daycare, school or other organizations.\n\n\n  <\/li>\n\n\n  <li>\n\n\n    <strong>99.107.8<\/strong> \u201cSecretary\u201d means the Administrator of the Delaware Department of Health and Social Services\n\n\n    (DHSS) of the State of Delaware, who shall hereafter in this document be referred to as: Secretary; The Secretary; or, Secretary, DHSS.\n\n\n  <\/li>\n\n\n  <li>\n\n\n    <strong>99.107.9<\/strong> \u201cSmoking\u201d means the burning of a lighted cigarette, cigar, pipe or any other matter or substance\n\n\n    that contains tobacco.\n\n\n  <\/li>\n\n\n  <li>\n\n\n    <strong>99.107.10<\/strong> \u201cVolunteer fire company\u201d means a fire, ambulance, or rescue company recognized as such by the\n\n\n    Delaware State Fire Prevention Commission.\n\n\n  <\/li>\n\n\n<\/ul>\n\n\n<p class=\"text-center\">\n\n\n  (<a class=\"anchors_link\" href=\"#content\">Back to Top<\/a>)\n\n\n<\/p>\n\n\n<h3 class=\"text-center\">\n\n\n  <a class=\"anchors\" id=\"ninetynine-two\"><\/a>Section 99.2 Smoking Prohibitions\n\n\n<\/h3>\n\n\n<h4>\n\n\n  99.201 Smoking Not Permitted\n\n\n<\/h4>\n\n\n<p>\n\n\n  Except as is provided in 99.301 of these regulations, and in order to reduce the levels of exposure to environmental tobacco smoke,\n\n\n  smoking shall not be permitted and no person shall smoke in any of the following areas:\n\n\n<\/p>\n\n\n<ol class=\"upper-alpha\">\n\n\n  <li>Any enclosed indoor area, including, but not limited to, those listed in 16 Delaware Code, Section 2903, to which the general public\n\n\n  is invited or in which the general public is permitted. This shall apply to any organization, business or establishment which caters to\n\n\n  or offers goods or services or facilities to, or solicits patronage from the general public.<br>\n\n\n    <br>\n\n\n    Organizations or businesses that maintain lists and\/or that charge nominal \u201cmembership fees\u201d or cover charges to the\n\n\n    general public prior to admission are not considered private clubs and will not be exempt from the Clean Indoor Air Act.\n\n\n  <\/li>\n\n\n  <li>Government owned and\/or operated means of mass transportationincluding buses, vans, trains, taxicabs and limousines.\n\n\n  <\/li>\n\n\n  <li>Functions or activities of private clubs or organizations, as defined by Section 99.107.5 of these regulations, when access by the\n\n\n  general public is allowed or solicited.\n\n\n  <\/li>\n\n\n  <li>Any private vehicle used for the public transportation of children or as part of health care or day care transportation.\n\n\n  <\/li>\n\n\n  <li>In private homes or private residences when such homes or residences are being used for childcare or day care.\n\n\n  <\/li>\n\n\n<\/ol>\n\n\n<h4>\n\n\n  99.202 Responsibility\n\n\n<\/h4>\n\n\n<p>\n\n\n  No owner of any indoor enclosed area subject to 16 Delaware Code Chapter 29 and\/or person(s) responsible for the management of such area\n\n\n  or employee thereof, shall permit or authorize smoking by any person(s) in areas not designated specifically for the smoking of tobacco\n\n\n  products as permitted by Section 99.301.\n\n\n<\/p>\n\n\n<p class=\"text-center\">\n\n\n  (<a class=\"anchors_link\" href=\"#content\">Back to Top<\/a>)\n\n\n<\/p>\n\n\n<h3 class=\"text-center\">\n\n\n  <a class=\"anchors\" id=\"ninetynine-three\"><\/a>Section 99.3 Smoking Prohibitions Inapplicable\n\n\n<\/h3>\n\n\n<h4>\n\n\n  99.301 Smoking Prohibitions Shall Not Apply\n\n\n<\/h4>\n\n\n<p>\n\n\n  Smoking prohibitions shall not apply in the following:\n\n\n<\/p>\n\n\n<ol class=\"upper-alpha\">\n\n\n  <li>Private homes, private residences and private automobiles,\n\n\n  <\/li>\n\n\n  <li>Any indoor area where private social functions are being held when seating arrangements are under the control of the sponsor of the\n\n\n  function and not the owner, operator, manager or person in charge of such indoor area;\n\n\n  <\/li>\n\n\n  <li>Limousines under private hire\n\n\n  <\/li>\n\n\n  <li>A hotel or motel room rented to one or more guests provided that the total percentage of such hotel or motel rooms does not exceed\n\n\n  twenty-five percent (25%).\n\n\n  <\/li>\n\n\n  <li>Any fund raising activity or function sponsored by a volunteer fire company, auxiliary of a fire company, or a volunteer ambulance or\n\n\n  volunteer rescue company; provided, however, that the fund raising activity or function takes place upon property owned or leased by the\n\n\n  volunteer fire, rescue or ambulance company.\n\n\n  <\/li>\n\n\n  <li>Any fund raising activity or function sponsored by a fraternal benefit society as defined by 18 Delaware Code \u00a76201; provided,\n\n\n  however, that the fund raising activity or function takes place upon property owned or leased by said organization.\n\n\n  <\/li>\n\n\n  <li>Any enclosed indoor area operated or in use exclusively by a private club as defined in 99.107.5 of these regulations.\n\n\n  <\/li>\n\n\n<\/ol>\n\n\n<p class=\"text-center\">\n\n\n  (<a class=\"anchors_link\" href=\"#content\">Back to Top<\/a>)\n\n\n<\/p>\n\n\n<h3 class=\"text-center\">\n\n\n  <a class=\"anchors\" id=\"ninetynine-four\"><\/a>Section 99.4 Posting of Signs\n\n\n<\/h3>\n\n\n<h4>\n\n\n  99.401 Failure to Properly Post and Maintain Signs\n\n\n<\/h4>\n\n\n<p>\n\n\n  Owners, operators, managers or other person(s) having control of enclosed indoor areas subject to the regulations of 16 DelawareCode\n\n\n  Chapter 29 shall post signs which indicate \u201cWarning: Smoking Permitted\u201d prominently to indicate those locations where smoking\n\n\n  is permitted pursuant to Regulation 99.301, B and D.
