<!--[type=HTMLEDIT name=\"Content\"]-->\n\n\n\n<p>\n\n\n  <strong>What is the Delaware Relative Caregivers\u2019 School Authorization Affidavit?<\/strong>\n\n\n<\/p>\n\n\n<p>\n\n\n  The Delaware Relative Caregivers\u2019 School Authorization law allows a caregiver raising a relative\u2019s child without custody or\n\n\n  guardianship to register that child for school.\u00a0 The law requires that the Delaware Relative Caregivers\u2019 School Authorization\n\n\n  Affidavit be completed in order for the school district to grant this power.\n\n\n<\/p>\n\n\n<p>\n\n\n  The Delaware Relative Caregivers\u2019 School Authorization law applies to all public schools in Delaware without exception.\n\n\n<\/p>\n\n\n<p>\n\n\n  <strong>Where can I\u00a0get a copy of the affidavit?<\/strong>\n\n\n<\/p>\n\n\n<p>\n\n\n  A\u00a0copy of the Delaware Relative Caregivers\u2019 School Authorization Affidavit can be <a href=\"sample.html\">downloaded from this\n\n\n  web site<\/a>. Copies of the Affidavit also can be obtained from any public school or school district office.\n\n\n<\/p>\n\n\n<p>\n\n\n  <strong>What responsibilities does the Delaware Relative Caregivers\u2019 School Authorization Affidavit place on me?<\/strong>\n\n\n<\/p>\n\n\n<p>\n\n\n  With this Affidavit completed and approved by your local school district, you are responsible for enrolling the student in school, being\n\n\n  the legal contact for the school regarding, but not limited to, truancy and discipline, making school-based decisions, regarding but not\n\n\n  limited to special education; and giving medical approval for health care administered by the school.\n\n\n<\/p>\n\n\n<p>\n\n\n  <strong>How long can an Affidavit be used?<\/strong>\n\n\n<\/p>\n\n\n<p>\n\n\n  The Affidavit can be used for up to two years of school or longer if the school district decides it is appropriate.\n\n\n<\/p>\n\n\n<p>\n\n\n  <strong>What information does the Affidavit require?<\/strong>\n\n\n<\/p>\n\n\n<p>\n\n\n  The questions on the Affidavit are asking mainly for you to show different proofs.\u00a0 You will be asked to prove your age, if the\n\n\n  child is under the care of a custodian or guardian, to show a copy of the part of the petition giving that authority, proof that you are\n\n\n  related to the child and proof that you are caring for him or her.\n\n\n<\/p>\n\n\n<p>\n\n\n  <strong>What are some examples of proof of caregiving?<\/strong>\n\n\n<\/p>\n\n\n<p>\n\n\n  Some proofs of caregiving are medical records showing that a caregiver\u2019s authorization to give approval for services such as\n\n\n  immunizations was acceptable; a letter from a social worker, lawyer, religious leader, licensed medical, mental health, or behavioral\n\n\n  professional or neighbor confirming the child is being cared for by the caregiver, or proof that the child\u2019s Social Security\n\n\n  Survivor death benefits are received by the caregiver for the child.\n\n\n<\/p>\n\n\n<p>\n\n\n  Other proofs are hospital, clinic, Public Health or Medicaid records where a caregiver\u2019s authorization to give approval for\n\n\n  services was acceptable, or Division of Services for Children, Youth, and their Families\u2019 records showing that the caregiver is the\n\n\n  contact for this child.\n\n\n<\/p>\n\n\n<p>\n\n\n  <strong>What are some examples of acceptable proof of relationship?<\/strong>\n\n\n<\/p>\n\n\n<p>\n\n\n  An acceptable example of proof of relationship is medical records where a caregiver\u2019s authorization to give approval for medical\n\n\n  services such as immunizations was acceptable.\u00a0 Such records must show the relationship between the caregiver and the child. If the\n\n\n  caregiver is a grandparent, their birth certificate, their adult child\u2019s birth certificate, and the birth certificate of the child\n\n\n  being cared for are acceptable.\n\n\n<\/p>\n\n\n<p>\n\n\n  Other examples are a will, which lists the child and the relationship between the caregiver and child, insurance for the caregiver or\n\n\n  child which includes the relationship between the caregiver and child, or a letter from a social worker, lawyer, religious leader,\n\n\n  previous school district, licensed medical, mental health, or behavioral professional that verifies the relationship of the child to the\n\n\n  caregiver.\n\n\n<\/p>\n\n\n<p>\n\n\n  Additional proofs are a completed and accepted National School Lunch Program application, hospital, clinic, Public Health, Medicaid, or\n\n\n  food stamp records showing the relationship between the caregiver and the child.\n\n\n<\/p>\n\n\n<p>\n\n\n  Other proofs are Division of Services for Children, Youth and their Families\u2019 records specifying the relationship between the\n\n\n  caregiver and child or military or veteran\u2019s records, which also specify relationship.\n\n\n<\/p>\n\n\n<p>\n\n\n  <strong>What proofs are acceptable for relationship OR caregiving?<\/strong>\n\n\n<\/p>\n\n\n<p>\n\n\n  Proofs that can be used to show relationship or caregiving are: The child is listed as occupant in an apartment or other housing and\n\n\n  his\/her relationship to the caregiver is included; the caregiver received a child-only Temporary Assistance for Needy Families (TANF)\n\n\n  grant; the child is claimed on the caregiver\u2019s Federal Income Tax return, or the caregiver receives Earned Income Tax Credit for\n\n\n  the child.\n\n\n<\/p>\n\n\n<p>\n\n\n  <strong>What are some proofs of a caregiver\u2019s efforts to contact the parent(s), custodian, or guardian?<\/strong>\n\n\n<\/p>\n\n\n<p>\n\n\n  If you are raising this child because the parent(s), custodian, or guardian cannot be located, you must show proof that you tried to\n\n\n  reach them regarding this Caregivers\u2019 School Authorization.\n\n\n<\/p>\n\n\n<p>\n\n\n  You are required to send a certified letter to the parent(s), custodian, or guardian at their last known address.
