A witness <em>cannot<\/em> be anyone who:\n\n\n<\/p>\n\n\n<ul>\n\n\n  <li>Is related to you by blood, marriage, or adoption\n\n\n  <\/li>\n\n\n  <li>Is entitled to any portion of your estate\n\n\n  <\/li>\n\n\n  <li>Has a claim against any portion of your estate\n\n\n  <\/li>\n\n\n  <li>Has a direct financial responsibility for your medical care\n\n\n  <\/li>\n\n\n  <li>Has a controlling interest or is an employee of a residential facility in which you reside\n\n\n  <\/li>\n\n\n<\/ul>\n\n\n<p>\n\n\n  If you are a resident of a long term residential health care facility,\u00a0one of the witnesses must be designated as a patient advocate\n\n\n  or ombudsperson by the Department of Health and Social Services.\n\n\n<\/p>\n\n\n<p>\n\n\n  For more information about witnessing the signing of an advance directive, see <a class=\"anchors_link\" href=\"http:\/\/delcode.delaware.gov\/title16\/c025\/index.shtml#2503\">Delaware Code Title 16 Subsection 2503<\/a> and <a class=\"anchors_link\" href=\"http:\/\/delcode.delaware.gov\/title16\/c025\/index.shtml#2511\">Subsection 2511<\/a>.\n\n\n<\/p>  <!--[END]-->\n\n  \n\n      <\/div>\n\n    <\/div>\n\n  <\/div><!-- \/container -->\n\n<\/div>","protected":false},"excerpt":{"rendered":"<p>Listen Who witnesses the signing of an advance directive?
