Change to Delaware Radiation Control Regulations


Effective November 13th, 2018, the following sets of regulations (Title 16 Delaware Administrative Code, 4465 Chapter 74, Radiation Control) were published as final rule: Parts A, B, D, F, H, K, and X. The regulations were amended to reflect changes or advances in the practice community, and to be more consonant with other state and federal regulations. Establishing radiation control regulations is the statutory mandate of the Authority on Radiation Protection, a governor-appointed public board which establishes the radiation control regulations to protect the public health and safety. The Office of Radiation Control is the administrative agent for the Authority, and carries out the regulations. Follow this link to see the entire regulation 4465. Following are highlights of the changes to the regulations:

Repealed and Replaced:

  • 4465 Part F – Medical Diagnostic and Interventional X-Ray and Imaging Systems
    Adopted Conference of Radiation Control Program Directors Suggested State Regulation, Part F (2015), with some modifications, such as amended definition of "Licensed Practitioner" to address advanced practitioners such as Physician Assistants and Advanced Practice Registered Nurses, addition of reportable diagnostic medical events and dose reduction considerations
  • 4465 Part H – Radiation Safety Requirements for Non-Healing Arts Radiation Generating Devices
    Adopted Conference of Radiation Control Program Directors Suggested State Regulation, Part H (2016), with some modifications to be more consonant with other chapters of Delaware radiation control regulations

Amended:

  • 4465 Part A – General Provisions
    Amended definitions of "Licensed Practitioner", "Qualified Medical Physicist", "Principle Supervisor", and added definition "Radiation Technologist"
  • 4465 Part B – Registration of Radiation Source Facilities and Services
    Amended definition of "Licensed Practitioner", "Qualified Medical Physicist", and "Principle Supervisor"
  • 4465 Part D – Standards for Protection Against Radiation
    Amended definition of "Licensed Practitioner", "Qualified Medical Physicist", "Principle Supervisor", and added definition of "Radiation Technologist"
  • 4465 Part K – Compliance Procedures
    Amended definition of "Licensed Practitioner" and "Qualified Medical Physicist"
  • 4465 Part X – Therapeutic Radiation Machines
    Amended definition of "Licensed Practitioner", added definition of "Radiation Therapist"
