IMPORTANT RULES

Employees enrolled in the disability insurance program must make application for disability benefits by the 15th calendar day of absence. If application for disability benefits is not made by the 31st calendar day of absence, then employees will be placed in an unpaid status until application for disability is made with The Hartford.

Once an employee exhausts their elimination period, the employee will be deemed to have applied for benefits under this section and shall not be eligible to utilize paid leave in lieu of application for short-term disability" (29 Del. C. §5253(b)(7)).

Employees must report all absences from work to their supervisor and must remain in contact with their supervisor on a regular basis throughout the duration of their disability.

"Employees are required to immediately report all absences from work to their supervisor and are required to stay in contact with their supervisor and Human Resource office during all absences from work. For specific reporting time frames, merit employees should refer to the Merit Rules."(29 Del. C. §5256(5.3)).

SHORT TERM DISABILITY & FMLA:

"Employees applying for STD benefits must also apply for the Family Medical and Leave Act (FMLA). While on FMLA, employees may retain one week of sick and one week of annual leave. Accruals that exceed the allowable one week of sick leave and one week of annual leave must be used as earned" (29 Del.C. §5256(9.1.3)).
