Delaware Health Fund Advisory Committee

Governor Thomas R. Carper signed Senate Bill 8 into law on July 20, 1999, creating the Delaware Health Fund to improve health care access and invest in long-term public health initiatives. The Delaware Health Fund is a special fund comprising all annual payments received pursuant to the Master Settlement Agreement entered into by the State of Delaware and the Participating Tobacco Manufacturers. The law also established the Delaware Health Fund Advisory Committee (DHFAC), which advises the Governor and General Assembly on how to allocate expected funds each fiscal year.

The committee’s recommendations align with the fund’s core goals, which include expanding access to affordable health care, enhancing health infrastructure, promoting preventive care, and reducing tobacco and substance use. Funds may also support innovative medical testing, treatment for lesser-known chronic diseases, and payment assistance programs for residents managing recurring medical costs.

In June 2026, Senate Bill 296, was signed into law. reforming the Health Fund Advisory Council process. Under the new process, the Division of Public Health (DPH) will release a Request for Proposal (RFP) to distribute the Delaware Health Fund and HFAC will convene in the fall to review a draft award list compiled through DPH’s RFP process, hear public testimony, and shape the final recommendations before they go to the Governor and Joint Finance Committee. The RFP will be available on bids.delaware.gov. The Bid Solicitation Directory is the State’s central repository across all three branches of state government that have an open Request for Information (RFI), Request for Quote (RFQ), Invitation to Bid (ITB), and/or a Request for Proposal (RFP).
