The Diamond State Hospital Cost Review Board monitors hospital spending to control rising health care costs. The Board consists of eight members: seven appointed by the Governor and confirmed by the Senate, and the executive director of the Delaware Healthcare Association. 

House Substitute 2 for House Bill 350 creates a requirement that hospitals submit yearly budgets, audited financial statements, and related financial information to the Board for review. Where a hospital fails to meet the state’s health care spending benchmark, it is required to engage with the Board on a performance improvement plan (PIP). If the Board determines that a PIP is required and the hospital cannot agree on a PIP or where the hospital fails to successfully implement a PIP, the Board may require the hospital to have its future budget approved by the Board.

In reviewing performance improvement plans or proposed budgets, the Board will consider adherence as closely to the spending benchmark as is reasonable given the hospital’s financial position and associated economic factors, the promotion of efficient and economic operations of the hospital, and maintenance of the hospital’s ability to meet its financial obligations and provide quality health care.

Public Comment: Diamond State Hospital Cost Review Board Annual Guidance for 2027 Data Submission

The Diamond State Hospital Cost Review Board (“Board”)  has released draft guidance and accompanying templates for public comment. The document sets out the reporting requirements, exhibits, and submission instructions with most material expected to be submitted by February 1, 2027.

Comment period: Tuesday, August 18th through Tuesday, September 1st at 4:30 p.m. ET.

How to comment: Submit written comments by email to DHCC@delaware.gov. Include the commenter’s name, organization (if any), and the section or exhibit to which the comment relates. Comments that identify a specific section, definition, or exhibit line item are most useful to the Board.

After the comment period: The Board will review all timely comments and may revise the draft before issuing the final document. The Board does not respond individually to comments.

Public records notice: Comments submitted to the Board are public records under 29 Del. C. §§ 10001 et seq. and may be posted or disclosed in full. Do not include confidential, proprietary, or personally identifying information you do not wish disclosed.
